Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tandaly LLC ("Ovana," "we," "us") governing your use of the Ovana website and application (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Ovana is

Ovana is education-pathway decision support. It shows what we checked, where we found it, and what still needs confirmation. It is not an official school, licensing board, DSO, or legal, immigration, financial, or medical determination.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. If you use it on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Your account

Keep your credentials secure and don't share your account. You are responsible for activity under your account and must notify us promptly of any unauthorized use.

4. License to use the Service

We grant you a personal, non-exclusive, non-transferable, revocable right to use the Service for your own education decisions, subject to these Terms.

5. Payments, balance, and refunds

Exploring pathways and risk flags are free. Paid structured reviews are charged against your Ovana balance, where 1 credit = $1. You always see the cost and a spending cap before you confirm. Balance does not expire, unused paid balance is refundable on request, and any check that cannot be completed or comes back inconclusive is refunded.

6. Your content

You keep ownership of the documents and details you provide. You grant us the limited license needed to host, process, and display that content to operate the Service for you, as described in the Privacy Policy. You are responsible for having the right to share what you upload.

7. Acceptable use

Use Ovana for your own genuine education decisions. Do not scrape, reverse engineer, resell, or overload the Service; do not upload unlawful, infringing, or malicious content; and do not use the Service to deceive others or violate any law. We may suspend or terminate accounts that break these rules.

8. Intellectual property

The Ovana software, brand, and content (excluding your content and third-party sources) are owned by Tandaly LLC and protected by law. These Terms do not transfer any of our intellectual property to you.

9. Third-party sources

The Service draws on federal, state, and institutional sources (see data credits). We certify the provenance of what those sources say; we do not control their accuracy or availability, and we are not responsible for third-party websites the Service may link to.

10. No guarantee of outcomes; "as is"

A verified check confirms the provenance of information as of the date checked. It does not guarantee admission, visa approval, licensure, employment, program availability, or final cost. The Service is provided "as is" and "as available," and, to the fullest extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. 11. Limitation of liability

To the fullest extent permitted by law, Tandaly LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US $100.

12. Indemnification

You agree to indemnify and hold Tandaly LLC harmless from claims arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.

13. Termination

You may stop using Ovana and close your account at any time. We may suspend or end access for violations of these Terms or to protect the Service and its users. Refundable balance remains refundable.

14. Governing law and disputes

These Terms are governed by the laws of the state in which Tandaly LLC is organized, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us to try to resolve it informally. Any dispute not resolved that way will be brought in the courts located in that state, and you consent to their jurisdiction.

15. Changes and contact

We may update these Terms and will change the "last updated" date above; material changes will be communicated before they take effect. Continued use after an update means you accept the revised Terms. Questions: support@ovana.me.
